THE STATUTE (2005)

Explanation:

Comrades, as it is known, rearrangement of the statutes determined by the decision of the 7th Conference; The task of simplifying it to make it more understandable and to be approved by the will of the party was to be concluded with the third meeting of the CC. The Central Committee completed this task at its third meeting, and the statutes we present below have been adopted by our party. All our members and committees will act in accordance with this charter.

Comrades, an attempt will be made to present a brochure containing an explanation of the articles of the statute in a short time. With this brochure, our aim is to get all members to understand the articles of the regulation at the level of understanding.

 

The Communist Party of Turkey / Marxist Leninist REGULATION

(Founded: April 24, 1972)

CHAPTER I

Qualifications and Purposes

a) TKP / ML; Turkey of the various nationalities of the proletariat is the vanguard party Guided by the theory of Marxism-Leninism-Maoism.

b) TKP / ML; He is the heir of the TKP led by Mustafa SUPHİ. The revisionist T "K" has nothing to do with P. It was established on April 24, 1972 under the leadership of İbrahim KAYPAKKAYA. Turkey has opened a new era in the establishment of the communist movement.

c) TKP / ML; It protects, defends and implements the teachings of the great leaders and teachers of the proletariat, Marx, Engels, Lenin, Stalin and Mao, with an uncompromising understanding of ideological struggle against revisionist, reformist and opportunist attacks of all kinds.

d) TKP / ML; It acts on the principle of drawing lessons from the experiences of the revolutionary struggles of the world proletariat and its peoples. The Paris Commune walks in their bright path, equipped with the experience of the Great October Revolution, the Chinese Democratic People's Revolution and the Great Proletarian Cultural Revolution.

e) TKP / ML; In the era of imperialism and proletarian revolution, internationalism "proletarian revolution in his own country to make" the fundamental principles of the revolution movement in Turkey, the world accepts as part of the proletarian revolution. It struggles to gather its members and all the people under the red banner of the proletariat against all forms of nationalism.

It struggles for the unity of the International Communist Movement on the basis of Marxist-Leninist-Maoist principles. It is aware that this unity can be achieved through ideological struggle.

It supports national and social liberation struggles that weaken and regress imperialism in the international arena.

While it adopts international proletarian solidarity, it is based on the principle of relying on its own power.

f) TKP / ML; In our country, whose socio-economic structure is semi-colonial, semi-feudal, after realizing the democratic people's revolution, it aims to reach communist society by building socialism under the dictatorship of the proletariat.

g) TKP / ML; In our country, where the Kemalist fascist dictatorship of the comprador bourgeoisie and the great landlords, which are connected to imperialism, is ruled, it acts according to the strategy of the people's war that will develop from the countryside to the cities where the armed struggle is based on the way of democratic people's revolution.

h) TKP / ML; It defends the principle of self-determination unconditionally and unconditionally. It opposes all national privileges and recognizes the full equality of rights of all nations. It is the most ruthless and determined enemy of the national oppression and persecution of the Turkish ruling classes against the Kurdish nation and minority nationalities. Determined to support the general democratic struggle of the Kurdish nation and minority nationalities against national oppression, oppression and privileges.

i) TKP / ML; It acknowledges the existence of classes, class struggles and, accordingly, irreconcilable contradictions in socialist society. At this stage, he implements the dictatorship of the proletariat and the proletarian cultural revolutions with the awareness that power can be taken over by the bourgeoisie and that capitalism can be rebuilt in a socialist country.

j) TKP / ML; It is based on voluntary union. It regards illegal organization as essential and other forms of organization secondary. It has a proletarian discipline that operates according to the principles of democratic-centralism. Applies self-criticism as a condition of progress. Understands the two-line struggle as the dynamics of development of the Communist Party. It does not allow the existence of factions that break the unity of will and action.

II. EPISODE

Party Membership

a) Membership Conditions

While giving priority to workers and peasants of class origin, anyone who fulfills the following conditions can become a member of the TKP / ML.

1- To accept the party program and statute.

2- Working on a party committee.

3- Paying the party fee regularly.

4- Being 18 years old.

b) Membership Transactions

Membership in the party is on an individual basis. The person who wants to become a member notifies the party committee with which he / she has a relationship in writing.

Membership application; The decision of the party committee, which includes at least three party members, is approved by the higher committee.

The decisions taken for party membership are forwarded to the Central Committee (CC) through the higher committees without delay. CC and District Committees (BK) can revoke membership decisions.

The person whose membership request is accepted by the authorized committees is accepted as a Candidate Member from the date of application. In cases where the party committee in the relationship suggests the person to apply for membership and the person agrees, the candidate membership starts from this date.

At the end of the six-month candidate membership period under strict supervision, the decision will be made by the party committee to which the person is affiliated. A decision of acceptance and rejection can be taken or the duration of candidate membership can be extended for six months with the approval of a higher committee. In case the rejection decision is made, if it does not involve any harm in terms of party security, the reason is notified to the person in writing.

After the congress or conference decision is taken, acceptance and dismissal from membership are suspended. Candidate memberships and new applications in this process are evaluated at or after the congress and conference.

c) Duties of the Member

1- To continuously raise its ideological-political level in order to improve itself; Therefore, to give special importance to reading, examination and research activities. To grasp and apply Marxism-Leninism-Maoism as a guide for action. Combining theory and practice

2- To examine all the publications of the party with a careful, critical eye; to be familiar with the leadership's policies and tactics in line with the party's central orientation.

3- All kinds of factional work to disrupt the unity and communist character of the party; To be alert, determined and relentless in the struggle against all anti-Marxism-Leninism-Maoist thought and currents. To have the courage to fight against the current, not to be afraid even under the conditions of being in the minority.

4- To comply with the party discipline unconditionally, to play an intellectual, creative and active role in the implementation of party decisions.

5- To be a student first in order to be a public teacher. To try to organize by participating in the spontaneous struggles of the people and to be at the forefront in order to give a conscious direction. To try to solve the difficulties together with the people and to make them comprehend the party politics and the laws of the class struggle.

6- To prioritize the cause of the people's emancipation, the struggle of the proletariat to reach a classless society, and the Communist Party, which pioneered these ideals. To have a consistent, humble, selfless and exemplary personality in his life, social relationships and behaviors. To live in accordance with communist principles and morals.

7- To fight against bourgeois-feudal value judgments and to raise awareness of the people in this direction. To actively oppose gender discrimination in all social spheres and to support general democratic movements in this direction and channel the struggle for revolution.

8- To be sincere and honest towards the party, its comrades, the people and itself. Being open, determined and courageous in criticism and self-criticism about not repeating mistakes, eliminating deficiencies and overcoming weaknesses. To use the weapon of criticism on the ground within the party and in a constructive way.

9- Paying ten percent of its income as a party fee, working to protect and develop the party's financial resources meticulously.

10- To report regularly to the committee to which he is affiliated about all his work.

11- By continuing the class struggle under conditions of imprisonment, turning the torture centers, prisons and courts into areas of resistance and propaganda of communism.

12- Strictly adhering to the rules of confidentiality / illegality in organizational work, carefully protecting party secrets and values.

13- To fulfill the tasks of proletarian internationalism, to fight against the oppression of oppressed nations and nationalities, against chauvinism and nationalism of all kinds.

d) Member's Rights

1- In the party committees he is a member of and in the party meetings he attended; to express opinions, make suggestions and criticisms about the politics and activities of the party; actively participating in the determination of party politics.

2- Choosing and being elected.

3- Defending oneself when accused and tried.

4- To consult in writing to all higher levels up to the CC about the problems that he cannot solve in the party committee of which he is a member.

5- Resigning from party membership provided that the reasons are given in written or oral form.

e) Rights and Duties of the Candidate Member

Party member candidates; It has all the rights granted to party members, except the right to elect, be elected, recruit, judge and vote for the determination of the party's will. Party members' duties also apply to candidates for members.

f) Jurisdiction and Disciplinary Penalties

1- Members and candidate members who break the union, do not comply with decisions and discipline, damage internal party democracy, misuse their duties, dismiss the party with their actions, are subject to investigation, prosecuted and punished.

2- The person to be judged is judged in the highest committee he works for, if there are at least two party members other than himself, or in a higher committee. Administrative measures (dismissal or freezing of powers, etc.) may be taken against the judged person or committees.

In addition, party committees or members can apply to the Central Supervisory Board (MDK) with a request for trial. The rejected requests are notified to the applicant in writing, together with their reasons.

It may establish commissions for investigations, but the trial is conducted by the MDK. In the periods when MDK is not established, MK fulfills this task. All decisions are made by simple majority.

3- After the investigation phase in which information and documents are collected and statements are taken; The trial begins with the direct and defense of the claims. Defense can also be done verbally. The person has to submit his defense no later than two months after the charges are submitted. If the two-month period is exceeded, the right to defense is deemed to have been used. If the person is found guilty; One of the following penalties is imposed, taking into account the degree of short and long-term damages caused by the crime committed to the party, the sincerity of the person on trial against the allegations and criticisms, the background of the party activity, the conditions under which the crime was committed and the exacerbating and aggravating consequences of other factors:

I- Warning, II- Heavy Warning, III- Dismissal, IV- Suspension of Candidate Membership, V- Dismissal.

Expulsion from the party is the heaviest punishment.

4- All disciplinary penalties are finalized after being approved by a higher committee. These decisions are immediately reported to the CC. The committee or member who has been punished can appeal up to the MDK. The MDK decides whether the penalty decision will be implemented until the appeal is finalized. Decisions made by the MDK regarding the trial come into effect immediately. MDK is responsible for congresses and conferences.

III. CHAPTER

Organization Principles

The organizing principle of TKP / ML is democratic centralism. According to this principle;

a) All central decisions are binding on the whole party. Members are obliged to fully implement party decisions, even if they find them wrong.

b) Members express their opinions on all matters related to party activities in the committees they serve and in the meetings they attend. Members can convey their opinions, suggestions and criticisms to the higher committee. Suppressing criticism within the party, blocking the way for criticism with administrative measures is incompatible with the principle of democratic centralism.

c) One discipline is valid in the party. As a requirement of this; individuals are subordinate to the party, the lower ranks to the upper echelons, the minority to the majority, the entire party to the CC, the MK Congress.

d) Until the democratic popular revolution, which is the minimum program of the party, takes place, only the MK and MDK come to power through bottom-up democratic elections, since illegal organization is essential. Other bodies are formed by appointment procedure. All members can propose candidates for the elections of MK and MDK, open a discussion by making an objection to the nominated candidates.

e) All committees must report to their superiors regularly on their activities. Reports, including objections and opinions, must be approved by all members of the committee.

f) All the governing committees of the party have to be accountable to their lower levels. A democratic consultation mechanism is operated between party committees.

g) All party committees are obliged to create a debate environment where members can criticize.

IV. EPISODE

Basic Organs

The main organs of the party are party cells.

Party cells; They are the collective working bodies of the members to achieve their tasks and organize the revolutionary struggle. He is responsible for arming with the MLM ideology through regular training and to train himself at a level that can apply communist theory to all areas of life.

It consists of at least three members or candidate members. Sympathizing committees under the leadership of members and candidate members are also organized in accordance with the cell system.

Each party cell has a secretary and an assistant secretary. The cell secretary is primarily responsible for all work carried out and maintains the link with the supreme committee. The assistant assumes his duties under the conditions of obstruction or absence of the free secretary. The cell secretary is obliged to prepare the assistant for this duty.

The party cells allow the party to take root in the masses and lead the masses.

Party cells; in villages, factories, schools, fascist state institutions; Within all mass organizations, primarily workers 'and peasants' organizations; in short, it is created wherever there are masses.

CHAPTER V

Governing Bodies

The governing bodies of the party; The Party Congress, the Party Conference, the Central Committee and the District Committees.

a-) Party Congress and Party Conference

The party congress is the highest organ of the party. The Congress has the authority to make changes in the party program and statute, to determine the periodic policies and tactics of the party, to resolve the party's ideological, political, military and organizational problems, to evaluate the CC activity report, and to elect CC members and substitute members.

Conference; It has the congress powers in matters other than changing the program. The party congress (party conference in the absence of congress) meets every three years.

The Congress meets under the leadership of the CC, on the condition that the number of delegates is not less than the absolute majority. MK may postpone the congress for a maximum of one year in extraordinary situations by obtaining the approval of the party will.

The Extraordinary Congress or Conference of the Party, with a preparation not exceeding six months, may be convened before the end of the usual three-year period, at the will of the CC or one third of the party members.

The congress is carried out by delegation. The number of members a delegate will represent is determined by MK. Delegates are elected by holding sub-regional congresses or conferences in the regions determined and under the control of the CC. All party members are obliged to attend sub-congresses.

MK members who cannot be elected as a delegate participate in the congress as natural delegates. Only elected delegates have the right to vote. The decisions for the program and regulation change are taken by two thirds of the total number of delegates, other decisions are taken by the absolute majority of the total number of delegates.

Although the members of the prisons do not have the right to elect a delegate during the preparation period for the congress, they have the right to express their opinions on the agenda items.

Captive party members can be elected as honorary members of the CC.

The position of the blocked MK member is suspended during his imprisonment.

b-) Central Committee

MK is the highest organ of the party between the two congresses. The number of members is determined by the congress. The conditions for being a delegate or attending the congress are not required for MK membership. The MK leads the party's ideological-political-organizational works in the light of the congress decisions and manages the party. It is primarily responsible for the organization of the party and for all activities.

The MK creates the necessary organizations to carry out the activities of the party, including the Political Bureau (MoH) and the Organization Bureau (ÖB). MoH is authorized on behalf of the PC in the period between meetings. It manages the party ideologically-politically. SB cannot change MK decisions. It directly leads the Central Broadcasting Organization and other broadcasting activity. ÖB is responsible for organizational leadership on behalf of the CC.

When the MK cannot establish a commission to manage the party's subsidiary organizations, it can assign these tasks to the comrades it will appoint on its behalf.

MK meets at least once a year. It can also hold an extraordinary meeting upon the call of the MoH or the request of one third of its members. Decision quorum is determined according to the absolute majority of the members of the body. The MoH determines the participation of the substitute members who do not have the right to vote by taking the opinions of other CC members.

If the CC cannot exceed the loss of will despite the successive participation of all alternate members, it may recruit one third of the number of permanent members from subordinate bodies. In the event that the will problem occurs again after this, the will of the party is applied for the solution method.

c-) Regional Committees

The central organization of the party is based on the regional system. Working places; It is divided into certain regions by taking into account economic, political and geographical conditions. A Regional Committee (BK) is established in the designated regions, depending on the PC. The CC has to take into account the opinions and suggestions of the sub-party committees when choosing members of the CB, which it has formed through appointment. The Regional Committee secretary, who is also a CC member, maintains the link between the CC and the CC. The secretary is primarily responsible for the work in the region. The UK leads the region in line with central politics.

With the knowledge and approval of the PC, it establishes party committees such as UK Sub-District Committees and Provincial Committees.

When deemed necessary, the Regional Committees, with the approval of the PC, organize regional conferences as a means of providing specific understanding of the party's policies and operating the democratic consultation mechanism.

VI. EPISODE

Workers and Peasants' Liberation Army of Turkey

TIKKO is the armed force of the people under the leadership of TKP / ML. The party manages TIKKO through the Military Commission (AK) attached to the MK. Party organizations are formed within TIKKO in accordance with the principle that politics should command weapons.

VII. EPISODE

Marxist-Leninist Youth Union of Turkey

TMLGB is a communist youth organization led by TKP / ML. The party leads the TMLGB through the CC's Youth Commission (GK).

VIII. EPISODE

Financial Resources

TKP / ML adopts the principle of relying on the public in generating income sources. The party's financial resources are membership fees, party taxes and donations, and the revenues obtained by force from the enemy, whose rates and amounts are determined by the PC. The PC regulates and controls all expenditures through their organizations. All party committees have to report regularly on their income and expenditure.

Members working as party workers give all their income to the party as long as they participate in production. The needs of party workers are met by the party.
